Nevada High Court Nullifies Sex Abuse Charges Against Actor

The Nevada Supreme Court has delivered a significant blow to the prosecution's case against Nathan Chasing Horse, ordering the dismissal of a high-profile sex abuse indictment.

According to The Washington Times, the state's highest court has reversed earlier rulings that had upheld the charges against the former "Dances with Wolves" actor.

The court's ruling, issued on Thursday, cited serious errors in the grand jury proceedings that led to the initial indictment. These errors, the court determined, had undermined the integrity of the process and necessitated the dismissal of the charges.

Court Cites Errors In Grand Jury Proceedings

The seven-member court's decision highlighted two primary issues with the grand jury process that led to Chasing Horse's indictment. First, prosecutors had presented an improper definition of grooming without expert testimony to support it.

Secondly, the court found that prosecutors had failed to provide the grand jury with exculpatory evidence, including inconsistent statements made by one of the alleged victims. These omissions, according to the court, significantly compromised the fairness of the proceedings.

The combination of these errors, the court stated, created "intolerable damage to the independent function of the grand jury process." This strong language underscores the seriousness with which the court viewed the prosecutorial missteps.

Implications For Future Prosecution Efforts

While the court's order directs the dismissal of the indictment, it does so without prejudice. This means that prosecutors have the option to refile charges against Chasing Horse if they choose to do so.

The court was careful to note that its decision was based solely on procedural issues and not on the merits of the case against Chasing Horse.

In its order, the court stated:

The allegations against Chasing Horse are indisputably serious, and we express no opinion about Chasing Horse's guilt or innocence.

This statement leaves the door open for future legal action should prosecutors decide to pursue the case further with a new indictment.

Background Of The Case Against Chasing Horse

Nathan Chasing Horse, 48, was arrested in January 2023 near his North Las Vegas home. The arrest came after a lengthy investigation into allegations that he had used his position as a self-proclaimed medicine man to gain access to vulnerable girls and women.

Chasing Horse, best known for his role as Smiles A Lot in the 1990 film "Dances with Wolves," faces criminal sexual abuse charges in multiple jurisdictions. These include U.S. District Court in Nevada and the Fort Perk Indian Reservation in Montana.

The allegations against Chasing Horse date back to the early 2000s and span across North America. Authorities claim he used his reputation as a spiritual leader to perform healing ceremonies, which allegedly provided him with opportunities to commit abuse.

Legal Challenges And Defense Arguments

Kristy Holston, the deputy public defender representing Chasing Horse, had argued for the dismissal of the case on multiple grounds. In addition to highlighting the errors in the grand jury process, Holston contended that the alleged sexual encounters were consensual.

However, prosecutors have noted that at least one of Chasing Horse's accusers was younger than 16, the age of consent in Nevada when the alleged abuse began. This aspect of the case adds another layer of complexity to the legal proceedings.

The Nevada Supreme Court's decision represents a significant setback for the prosecution, but it does not necessarily mark the end of the legal saga surrounding Nathan Chasing Horse. The case has drawn widespread attention and has implications that extend beyond Nevada's borders.

Why This Story Matters

This development holds significant weight for the legal precedent it sets regarding the conduct of grand jury proceedings, especially in cases with substantial media and public interest. The integrity of the criminal justice process is critical in ensuring fairness and proper conduct of law, and this case highlights potential pitfalls within that system.

Moreover, as the allegations involve large, underserved Indigenous communities, the case also underscores the need for meticulous legal proceedings to prevent injustice. The possibility of re-filing charges presents a critical juncture for reevaluating and refining the justice approach in similar future cases.

In conclusion, the recent overturning of Nathan Chasing Horse's sex abuse indictment by the Nevada Supreme Court invites a thorough revisitation of both the legal strategy and procedural application in criminal cases. As observers await the potential re-filing of charges, the case remains a pivotal learning curve in the application of justice in complex criminal cases enveloped by cultural sensitivities and legal intricacies.
