Florida man who launched GoFundMe after husband’s death charged with murder

Herbert Swilley stands accused of first-degree murder following the demise of his spouse, Timothy Smith, in their shared residence.

On November 4, 2022, the tranquility of Ocala, Florida was shattered when Herbert Swilley, 55, was apprehended and charged with the murder of his 59-year-old husband, Timothy Smith.

The grim discovery of Smith’s body on March 25, 2022, marked the beginning of a complex investigation. Smith was found lifeless, partially unclothed, exhibiting signs of a brutal encounter.

A community in mourning

The local community was initially touched by Swilley's seemingly desperate plea for help when he reported Smith missing on March 24, after he failed to report to work.

His subsequent GoFundMe campaign, purportedly to aid in the search for his missing husband, garnered financial support from sympathetic donors, People reported.

However, the discovery of Smith's body a day later by police conducting a welfare check suggested a more sinister reality. The medical examiner's findings were unequivocal: asphyxia due to a cervical spine fracture.

Investigation Unveils a suspect

As the investigation unfolded, it became clear that Swilley's initial cooperation with the authorities was short-lived. After providing an initial statement, Swilley enlisted legal representation and ceased further communication with the police. In August, the veil of suspicion was lifted, and Swilley was publicly named as the prime suspect in the case.

Police reports and interviews with friends of the couple painted a disturbing picture of the relationship's undercurrents. Allegations of Swilley’s violent tendencies and threats cast a new light on the events leading to Smith’s death.

A friend's testimony to the police read, "Swilley had a history of violent outbursts, a bad temper and had made 'homicidal threats.'" Another poignant revelation came from the same friend, who revealed, "Smith was 'sick' of taking care' of Swilley."

The investigation also implicated Swilley in the possible concealment and destruction of evidence. It is alleged that he disposed of not only the household carpets but also crucial doorbell camera footage following Smith's death.

Evidence leading to an arrest

Swilley's daughter, Jordan, also came under scrutiny, being named a person of interest. Meanwhile, two individuals, close to the heart of the matter, voiced their apprehensions about potential repercussions for cooperating with law enforcement.

Despite the fear, friends remembered Smith fondly, highlighting his passion for empowering others, his vibrant attire, and his ability to radiate warmth and love.

Timothy Smith, according to those who knew him well, was a beacon of positivity, someone who adorned flashy outfits and had a personality that made him stand out in a crowd.

His loss is not only a private tragedy but also a collective one, for a community that valued his generosity and kind spirit.
