Former FBI task force leaders charged with false statements on Hunter Biden laptop

Two former senior FBI intelligence officials surrendered on federal arrest warrants after the Justice Department charged them with making false statements to Congress about their roles in Hunter Biden probes, including the laptop that surfaced in the closing weeks of the 2020 presidential race.

Just the News reported that Nikki Floris and Bradley Benavides appeared in federal court on the charges, which grow out of a 2023 House Judiciary Committee investigation into the bureau’s since-dissolved Foreign Influence Task Force.

The case puts hard legal pressure on former officials who once sat near the center of the FBI’s foreign election-interference work. Prosecutors say their 2023 testimony hid the task force’s real engagement with Biden-related investigations. For conservatives who watched the laptop story get buried, the charges mark a rare move to treat alleged deception of Congress as a criminal matter rather than a closed chapter.

Who they were inside the FBI

Floris, also identified in charging coverage as Nikki Cole Floris, specialized in foreign election interference. FBI Director Kash Patel said she led the Foreign Influence Task Force as deputy assistant director from mid-2019 through mid-2022.

Benavides held a parallel post as section chief from mid-2019 through the 2020 election, Patel said. The Associated Press has identified both as specialists in foreign election interference. The task force itself has since been dismantled.

Hunter Biden’s laptop, as described in the reporting, included information about his overseas business dealings while his father, Joe Biden, served as vice president. That material became a flashpoint in the final stretch of the 2020 campaign and later a focus of congressional scrutiny of how the FBI handled it.

Readers following Biden family legal exposure have also watched related accountability fights, including the Biden ghostwriter tapes released after a two-year court battle.

What prosecutors say they told Congress

A Justice Department affidavit dated Oct. 20 states that Floris and Benavides made “materially false statements” during the House Judiciary Committee’s 2023 probe. The disputed testimony concerned their involvement with the specialized foreign-influence task force and their knowledge of the laptop.

Fox News reported that both surrendered on arrest warrants and that the Department of Justice cites email evidence showing they discussed the matters even after later denials under congressional questioning.

Patel summarized the core clash in plain terms. Both officials testified that the FITF was not involved in the Hunter Biden investigations. He said the record points the other way.

"Documentary evidence, contemporaneous communications, and witness accounts contradict their testimony."

The Washington Examiner reported that the criminal complaint places the disputed testimony in July and September of 2023 and states that numerous pieces of documentary evidence, contemporaneous communications, and witness accounts contradict what they told lawmakers.

Patel also announced the arrests directly.

"This morning the FBI arrested two former FBI members of the now dissolved Foreign Influence Task Force, Nikki Floris and Bradley Benavides, both of whom allegedly lied to Congress in 2023 on matters regarding investigations related to the 2020 election."

The alleged cover story in detail

National Review reported sharper particulars from the charging theory. Benavides claimed he only learned of the laptop from Wikipedia in 2023. Floris denied any discussions about Hunter Biden.

Prosecutors reject those accounts. They argue the statements were not slip-ups. In the charging papers, they say the evidence establishes probable cause that Floris and Benavides made the statements “for the purpose of concealing [the Foreign Influence Task Force’s] engagement with and communications about the Hunter Biden investigations and impeding the congressional investigation.”

That is the heart of the case as filed: not only false answers, but false answers meant to block Congress from seeing what the task force knew and did.

Institutional fights over FBI power and political investigations remain a live theme in Washington, including after the White House release of declassified FBI memos on earlier bureau controversies.

Patel’s broader claim about 2020

Patel went further on Floris’s conduct during the election period. He alleged she was recorded privately claiming to be “running a shadow government” in her task force role during the 2020 election. The full recording, its exact date, and its complete wording have not been released publicly in the coverage of the charges.

He framed senior false testimony as an attack on basic constitutional order.

"Lying to Congress by senior FBI officials strikes at the heart of our system,..."

U.S. Attorney Jeanine Pirro struck a harder enforcement note in her own statement on the arrests.

"Lying to Congress by anyone strikes at the heart of our democratic system, but when senior FBI agents lie to Congress believing they are above the law, it’s time to bring the hammer of justice down on them."

The defense pushback

Floris’s attorney rejected the government’s theory and cast the case as political. The attorney said she “served our nation as a dedicated FBI intelligence officer for nearly 20 years. Yet today, the DOJ has accused her falsely of a crime on the say-so of politicians, not on the facts.”

The same defense message treated the timing as suspect, pointing to the accusation landing right before the midterms. The attorney’s name was not included in the reporting. No public statement from Benavides or his counsel appeared in the same accounts.

No public results have been released that list the precise criminal statutes, docket number, or bond terms. Investigators and the court process will still have to test the emails, witness accounts, and contemporaneous communications against the 2023 answers line by line.

What still has to be proven

The charging documents allege material falsehoods. They do not, by themselves, equal a conviction. A federal case of this kind turns on what questions Congress asked, what answers were given, and whether prosecutors can prove the speakers knew those answers were false.

Authorities have not publicly released the full, unredacted Oct. 20 statement of facts in the news accounts of the arrests. They have also not released a complete transcript package of the July and September 2023 testimony alongside the claimed contradicting emails.

Those gaps matter. False-statement cases often rise or fall on wording, context, and intent. The defense will press the “say-so of politicians” line. Prosecutors will press concealment and obstruction of the House probe.

Separate from this prosecution, courts are still sorting major Biden-era policy fights, including a D.C. Circuit order keeping billions in IRA green bank grants frozen.

Why the laptop fight never left the stage

The laptop controversy sits at the center of a larger trust collapse between much of the public and federal law enforcement. Conservatives argued for years that intelligence and bureau channels helped smother a damaging story before voters could weigh it. Democrats and many legacy outlets treated those concerns as conspiracy talk.

These charges do not rewrite 2020. They do something narrower and more concrete. They put two former FITF leaders into criminal court over what they told Congress in 2023 about the task force’s contact with Hunter Biden investigations.

If the Justice Department proves its theory, the verdict will be about more than two careers. It will be about whether senior FBI officials can tell Congress the task force was uninvolved while emails and witnesses show otherwise.

If the defense prevails, Floris and Benavides will argue they were dragged into a political sequel and accused without facts. Either way, the courtroom now becomes the forum the public was denied when the laptop fight was still a pre-election media war.

Congress cannot do oversight if senior agents can wall off a task force with sworn denials. The charges say that wall was deliberate. A jury will decide whether the evidence breaks it open.
