Harvard professor set to self-deport after BB gun incident near synagogue

The day before one of Judaism’s holiest holidays turned tense in Brookline, Massachusetts, when a Harvard Law School professor was arrested for discharging a BB gun just steps from a local synagogue.

Carlos Portugal Gouvea, a Brazilian legal scholar visiting the U.S. on a J-1 educational visa, has agreed to leave the country after firing a BB gun near a synagogue on Oct. 2, leading to an arrest, visa revocation, and plea deal, as The Hill reports.

On the eve of Yom Kippur, a BB gun was fired near Temple Beth Zion, a synagogue in Brookline. Authorities arrested Gouvea -- then a visiting professor at Harvard Law School -- after reports of gunfire. The incident sparked alarm in the community, heightened by the timing and location of the shots.

Incident Unfolds on Eve of Jewish Holiday

The BB gun was reportedly fired near the synagogue on the evening of Oct. 2, when many members of the Jewish faith were preparing for Yom Kippur. The federal Department of Homeland Security swiftly responded to the incident, calling it a display of “brazen antisemitism.” The statement intensified scrutiny around the event and the professor’s intent.

However, local authorities later released information that complicated the alleged motive. Brookline police reportedly told the synagogue that Gouvea claimed he was unaware of both the location and the religious significance of the day. According to law enforcement, he was living next to the synagogue without realizing it.

When questioned, Gouvea defended his actions by claiming he was “hunting rats” in the area. His assertion gained some context when residents and city records noted that Brookline had been recently experiencing a sharp increase in rodent activity.

Local and Federal Authorities Disagreed on Motive

The reported motive publicized by Gouvea appeared to stand in contrast to Homeland Security’s labeling of the event. According to Reuters, neither the synagogue nor local police considered the act to be rooted in antisemitic intent. This tension between local findings and federal reaction added complexity to an already charged situation.

Brookline’s official city records note the surge in rodent infestations and include public initiatives to combat the issue. These publicly available resources were cited as possible circumstantial support for Gouvea’s explanation. Still, firing an air rifle near a religious center raised community concerns, regardless of perceived intent.

After the arrest on Oct. 2, the legal response unfolded quickly. Two weeks later, on Oct. 16, federal immigration officials revoked Gouvea’s visa. The revocation left him without legal status in the U.S., effectively leading to further law enforcement scrutiny.

Plea Deal Accepted in November for Reduced Charges

In November, Gouvea accepted a plea deal. He admitted to the illegal use of an air rifle, which allowed prosecutors to dismiss other charges, including disturbing the peace and disorderly conduct. The plea helped resolve the criminal portion of the case without moving to trial.

The agreement did not erase the immigration consequences faced by the professor. Although he avoided jail time, he remained in the sights of federal immigration enforcement. The decision kept the issue out of the courtroom but still triggered his removal from the U.S.

Earlier this week, Immigration and Customs Enforcement (ICE) officers from Boston’s Enforcement and Removal Operations arrested Gouvea once again. The arrest came as part of formal deportation proceedings.

Harvard Educator Agrees to Exit US

After his ICE detention, Gouvea agreed to voluntarily depart the U.S. and return to Brazil. This form of self-deportation can sometimes help individuals avoid the long-term legal consequences associated with forced removal, such as future travel restrictions or official bans.

Gouvea’s status as a foreign scholar and his admission to the weapons violation played pivotal roles in both terminating his academic appointment and ending his stay in the country. Harvard officials have not publicly commented on the case. There have been no additional criminal charges since the plea, and Gouvea has not been accused of any additional wrongdoing since the initial offense. The synagogue has also not issued any public statements after the ICE action.

1. Always know your surroundings: Firing any type of weapon -- even a BB gun -- without verifying your location can have serious consequences. This is particularly true near places of worship or schools, where sensitivity is heightened.

No matter the precautions taken, crime and misunderstanding can still affect anyone. It is critical to remember that blame should never be placed on innocent bystanders or those impacted by malicious or negligent actions.
