DC prosecutor declines arrest warrant for congressman in assault case

An accusation of physical assault involving Rep. Cory Mills (R-FL) and a refusal by a federal prosecutor to approve an arrest warrant has stirred controversy in Washington, D.C.

In relation to an alleged domestic violence scenario, Ed Martin, an ally to President Donald Trump, did not sign off on the arrest of Mills, who was accused by a woman of physical assault, with police probes ongoing, as Rolling Stone reports.

The Incident and Immediate Police Response

Last Wednesday, an alleged assault occurred at Mills' Washington residence. The Metropolitan Police Department (MPD) was notified, and officers responded to the scene.

According to the police report obtained, the incident involved Mills allegedly grabbing a 27-year-old woman, shoving her, and pushing her through a door.

The woman, reportedly involved romantically with Mills, displayed bruises and played an incriminating phone call to the police in which Mills suggested she lie about the origin of her injuries.

The victim initially supported the idea of pressing charges, although she later recanted some of her accusations, adding complexity to the case.

Legal Back-and-Forth Ensues

By Friday, an arrest warrant was drafted for Mills and forwarded to the U.S. Attorney's office for approval. Despite the evidence and initial police findings, Martin, who has previously described himself as "President Trump’s lawyer," opted not to authorize the arrest warrant. Instead, the case was sent back to MPD for further investigation.

Mills has categorically denied any wrongdoing through a press release, expressing his confidence that further investigation would absolve him of all accusations. The alleged victim shifted her stance, attributing her accusations to severe jet lag and sleep deprivation and denied that any physical altercation took place.

This revised statement was issued to Politico: "[I] had been severely jet-lagged and sleep-deprived... There was no physical altercation [...]", describing the situation as emotionally charged.

Internal Affairs Takes Deeper Look

The handling of the case by MPD raises questions about due process and the enforcement protocols for incidents involving high-profile figures. D.C. law permits an arrest to be made at the scene of intra-family disputes based on probable cause irrespective of later recantation.

MPD's leadership was prompted to review the initial responses upon becoming aware of the incident. A statement from MPD highlighted that they are now conducting an internal investigation by the Internal Affairs Bureau to ensure compliance with procedural standards.
